Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Marcelo application and website (the “Service”), operated by Maciej Stopa, sole proprietor (the “Provider”), NIP <REPLACE_WITH_NIP>, Poland.
1. Acceptance
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Subscription
The Service is offered on a subscription basis through Apple App Store and Google Play. A 7-day free trial precedes the first paid period. After the trial, your store account is charged automatically at the prevailing monthly price unless you cancel. You manage your subscription from your phone’s native store settings — we never have access to your payment method.
3. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract our prompts, models, or any non-public infrastructure.
- Use the Service to scrape, mirror, or republish the daily brief in bulk.
- Submit content (custom queries, reaction notes) that is illegal, infringing, or violates the rights of others.
4. Content ownership
You retain ownership of any content you submit (custom queries, interests, reactions). The daily brief itself is generated for you; you may consume it freely, but it is curated from third-party sources whose copyright remains with their original authors. We do not grant you a licence to redistribute the brief.
5. Subprocessors and data handling
See the Privacy Policy for the list of subprocessors and how your data is handled.
6. Termination
You may cancel your subscription at any time. You may delete your account at any time from Settings → Account → Delete account. We may suspend or terminate your account if you violate these Terms, with notice where reasonable.
7. Disclaimers
The Service is provided “as is”. The daily brief is a curated summary of third-party content. We do not guarantee accuracy, completeness, or fitness for any particular purpose. Do not rely on the Service for medical, legal, financial, or safety-critical decisions.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
9. Governing law
These Terms are governed by the laws of Poland. Disputes shall be resolved in the courts having jurisdiction over the Provider’s registered office.
